Title : Secondary/Additional Professional Activities and Outside Activities of Employed Practitioners Policy and Procedure Number : 3977, Version : 1 F. Employed Advanced Practice Provider means an Advanced Practice Provider who is employed by the applicable Medical Group. G. Employed Physician means a Physician who is employed by the applicable Medical Group; provided, however, that, for purposes of this Policy an Employed Physician does not include a Physician who is employed by Banner (1) on a per diem basis, (2) on a part-time basis with Banner as the Physician's secondary employer, or (3) solely for the purpose of providing medical director services or other full-time administrative leadership services. H. Employed Practitioner means an Employed Physician or an Employed Advanced Practice Provider. I. Employment Agreement means a written legal document that describes the terms and conditions under which (a) a Physician becomes an employee of the applicable Medical Group, or (b) an Advanced Practice Provider becomes an employee of the applicable Medical Group in the event that a written employment agreement is required. J. Intra-Entity Agreement/Special Provision means a written legal document between the applicable Medical Group and another Medical Group or the applicable Medical Group and Banner that describes the terms and conditions under which one or more Employed Practitioners will provide approved Secondary/Additional Professional Activities to the other Medical Group or to Banner, as the case may be. K. Medical Group means the Banner entity that employs the Employed Practitioner, which may be BMG, BMGC, B—UMG, BUCS or Banner Health. L. Outside Activity means any professional activity related to the practice of medicine to be provided by an Employed Practitioner to an Outside Entity that has been determined by the applicable Medical Group or by SPAC to be outside the scope of the Employed Practitioner's employment by the applicable Medical Group and that has been otherwise approved by the applicable Medical Group or by SPAC. M. Outside Entity means any entity or person, other than Banner, such as a pharmaceutical company, a device manufacturer, or a long-term care facility, that has, or seeks to have, an arrangement or relationship with, or for the services of, an Employed Practitioner or a prospective Employed Practitioner; provided, however, that, for purposes of this Policy, the University of Arizona will not be considered an Outside Entity with respect to B—UMG. N. PAT means the Provider Approval Team, which is the committee of BMG and BMGC that (a) reviews Secondary/Additional Professional Activities to be provided by an Employed Practitioner or a prospective Employed Practitioner to BMG, another Medical Group or Banner, and (b) approves the Secondary/Additional Compensation to be received by an Employed Practitioner as a result of approved Secondary/Additional Professional Activities provided by the Employed Practitioner to BMG, another Medical Group or Banner. O. Physician means a doctor of medicine or osteopathy, a doctor of dental surgery or dental medicine, a doctor of podiatric medicine, a doctor of optometry, or a chiropractor. P. Physician-Owned Distributorship (POD) means a business entity, often a joint venture, involving Physicians and non-Physicians, usually a manufacturer’s representative or distributor who is involved in selling medical devices, including prostheses, implants, etc. ("Items"), that is created to purchase Items directly from the manufacturers and then sells such Items to hospitals, clinics, surgery centers and similar organizations. The Physician owners in the POD are also the Physicians acquiring and using the Items (e.g., implanting a medical device) purchased from the POD. Q. Physician Payment Sunshine Act means Section 6002 of the Patient Protection and Affordable Health Care Act, which requires pharmaceutical, medical device, biological,
