Title : Secondary/Additional Professional Activities and Outside Activities of Employed Practitioners Policy and Procedure Number : 3977, Version : 1 and medical supply manufacturers to report to Health and Human Services any “payment or other transfer of value” to Physicians and teaching hospitals. R. Primary Activity means the primary clinical activity or activities that an Employed Practitioner is employed by the applicable Medical Group to provide. For Employed Practitioners employed by B—UMG, the Primary Activity also includes academic activities such as teaching, research and academic leadership. S. Secondary/Additional Professional Activity means any professional activity related to the practice of medicine, other than a Primary Activity, to be provided by an Employed Practitioner to the applicable Medical Group, to another Medical Group, to Banner or to an Outside Entity within the scope of an Employed Practitioner's employment by the applicable Medical Group. Examples of Secondary/Additional Professional Activities include serving as a medical director, performing EKG or dexascan panel readings, engaging in speaking opportunities, performing teaching activities, providing consulting services, testifying as an expert witness, or serving as a medical staff leader. T. Secondary/Additional Compensation means the financial benefit received by an Employed Practitioner from the applicable Medical Group as compensation for the Secondary/Additional Professional Activities performed by the Employed Practitioner within the scope of the Employed Practitioner's employment by the applicable Medical Group. An Employed Practitioner may receive Secondary/Additional Compensation through additional periodic payments made to the Employed Practitioner, through the receipt of AwRVUs, through inclusion in the base salary, or through other means as may be determined by the applicable Medical Group. U. SPAC means the Secondary Professional Activities Committee, which is the committee of Banner that reviews Secondary/Additional Professional Activities and Outside Activities to be provided by an Employed Practitioner or a prospective Employed Practitioner to any Outside Entity. V. Stark Statute means the federal physician self-referral law (the “Stark law”) (42 U.S.C. S 1395nn) that prohibits a Physician from referring Medicare patients to entities with which the Physician has a financial relationship for the provision of designated health services ("DHS") and that prohibits entities from billing for DHS furnished pursuant to a prohibited referral. W. UPRT means the University Provider Approval Team, which is the committee of B— UMG that reviews (a) Secondary/Additional Professional Activities to be provided by an Employed Practitioner or a prospective Employed Practitioner to B—UMG, another Medical Group, Banner or the University of Arizona, and (b) approves the Secondary/Additional Compensation to be received by an Employed Practitioner as a result of approved Secondary/Additional Professional Activities provided by the Employed Practitioner to B—UMG, another Medical Group, Banner or the University of Arizona. The scope of an Employed Physician’s employment by the applicable Medical Group extends to all activities of the Employed Physician related to the practice of medicine (including teaching, consulting, speaking, lecturing, writing, research, expert consultation and witness services, and the development or sale of medical, healthcare-related, nutritional or other products related to the practice of medicine in the Employed Physician’s specialty, or the Employed Physician’s status as a Physician). 2.
